Notice of Privacy Practices

This Notice of Privacy Practices (“Notice”) describes how health information about you may be used and disclosed and rights you may have with respect to such information. Please review it carefully.
More specifically, the Notice describes how Nourish, Inc., and its associated provider groups Nourish Medical Group, P.C., Nourish PLLC, Nourish Medical Group (KS) LLC, and Nourish P.A. (each, a “Nourish Provider” and collectively, the “Nourish Provider Group,” “we,” “us,” or “our”) collect, use, and disclose your health information.
This Notice applies to services provided by the Nourish Provider Group, including through Nourish’s technology platform (the “Nourish Platform”), involving the use or disclosure of health information (referred to collectively as the “Services”).
As used in this Notice, “health information” means information about you that may be used to identify you and that relates to your past, present, or future physical or mental health condition; the provision of healthcare services to you; or your past, present, or future payment for the provision of healthcare services. It includes “protected health information” under HIPAA and “medical information” under similar medical privacy laws. This also includes how we use and disclose information that you may agree to provide us access to through Apple HealthKit (available to users as “Apple Health”) on iOS and the Health Connect API on Android. See the Health App Data Sharing section herein for more information.
Health information does not include information that cannot be used to identify you, such as de-identified information, and it does not include information that is not related to past, present, or future health conditions, or the provision of or payment for past, present, or future health care services.

This Notice describes:
- The purposes for which we may use and disclose health information
- Rights and choices you may have regarding your health information
- Our obligations under applicable law with respect to health information
OUR USES AND DISCLOSURES
How do we typically use or share your health information?
We may use or share your health information in the following ways, subject to restrictions or requirements under applicable law:
Provide our Services
- We may use and share your health information to provide our Services, including to facilitate access to tools we offer to help you manage your health journey you through the Nourish Platform
- We may use and share your health information to communicate with family members and others who are involved in your care and payment thereof, to the extent permitted under applicable law.
Treatment
- We may use your health information and share it with other professionals who are treating you, such as disclosures to doctors or therapists for treatment purposes.
- We may participate in shared health data platforms and health information exchanges so that we can share, request, and receive electronic health information from other health care organizations for our treatment, payment, and healthcare operations purposes.
- We may use and share information about your lab test results in connection with the provision of our Services.
- We may use and share your health information to recommend different treatments or types of health care providers to support your treatment.
Operate our organization
- We may use and share your health information with other entities to provide our Services, improve your care, and contact you, such as to analyze patterns of use and improve our Services.
Bill for our Services
- We may use and share your health information to bill and get payment from health plans or other entities, including by sharing your information with your health insurer.
How else can we use or share your health information?
We are allowed or required to use or share your information in other ways, subject to requirements under applicable laws. This may include the following:
Help with public health and safety issues
- We can share health information about you for certain situations such as:
- Preventing disease
- Helping with product recalls
- Reporting adverse reactions to medications
- Reporting suspected abuse, neglect, or domestic violence
- Preventing or reducing a serious threat to anyone’s health or safety
Engage in research
- We can use or share your health information for health-related research activities.
Work with a medical examiner or funeral director
- We can share health information with a coroner, medical examiner, or funeral director to help determine cause of death or for identification purposes.
De-identification
- We can also use and share health information for purposes of de-identifying, encoding, encrypting, or otherwise anonymizing data.
Comply with the law and protect our legal interests and interest of others
- We can share information about you if state or federal laws require it, including with the Department of Health and Human Services if it wants to see that we’re complying with federal privacy law.
- We can share health information to respond to a court or administrative order, in response to a subpoena, or to provide information to governmental entities that we believe is required under applicable law or that is necessary in order to protect our rights or the rights of others.
- We can share health information for worker’s compensation claims.
Disclosures for which we need your authorization
The uses and disclosures described in this Notice are permitted under applicable law. In some cases, applicable law requires that we obtain your written authorization before disclosing your health information to third parties. Those are, consistent with applicable legal requirements, to:
- Use or share notes documenting or analyzing the contents of counseling sessions, where such use or disclosure is for a purpose other than for treatment, payment, or health care portions involving (i) use by the originator (e.g., registered dieticians) of the notes; (ii) our use or disclosure for training purposes; (iii) use or disclosure for our defense in a legal action or other proceeding; or (iv) for uses or disclosures required or permitted under applicable law.
- Use or share health information for marketing; and
- To sell your health information
If you provide us with written authorization to make these types of disclosures, you can revoke your authorization at any time.
If you provide us with access to your health information through HealthKit/Apple Health or Health Connect, we may have more restrictive disclosure policies regarding that data. See the Health App Data Sharing section below.
YOUR RIGHTS
When it comes to your health information, you have certain rights under applicable law. This section explains those rights and some of our responsibilities to help you.
Obtain an electronic or paper copy of your medical record
- You can ask to see or get an electronic or paper copy of your medical record and other health information we have about you. You can do this by emailing support@usenourish.com. We will provide a copy or a summary of your health information, usually within 30 days of your request. We may charge a reasonable cost for doing so.
- Please note that we may not be legally permitted to provide you with copies of some of your medical records, such as notes from your sessions with therapists and registered dieticians.
Ask us to correct your medical record
- You can ask us to correct health information about you that you think is incorrect or incomplete. Ask us how to do this.
- We may say “no” to your request, but we’ll tell you why in writing within 60 days.
Request confidential communications
- You can ask us to contact you in a specific way (for example, home, office, or cell phone) or to send mail to a different address.
Ask us to limit what we use or share
- You can ask us not to use or share certain health information for treatment, payment, or our operations. We are not required to agree to your request, and we may say “no,” for example, if it could affect your care. If we agree to your request, we may still share this information in the event that you need emergency treatment.
- If you pay for a service or health care item out-of-pocket in full, you can ask us not to share that information for the purpose of payment or our operations with your health insurer.
Request a list of those with whom we’ve shared information
- You can ask for a list (accounting) of the times we’ve shared your health information for six years prior to the date you ask, who we shared it with, and why, with the exception of disclosures for treatment, payment, and health care operations, and certain other purposes in accordance with applicable law. We will provide one accounting a year without charge, but will charge a reasonable fee if you ask for an accounting more than once in a 12-month period.
Get a copy of this Notice
- You can ask for a copy of this Notice at any time.
Designate someone to act for you
- You can designate someone to act as your personal representative, such as if someone has your medical power of attorney or if someone is your legal guardian, that person can exercise your rights and make choices about your health information.
- We will make sure the person has this authority and can act for you before we take any action.
Control recipients of health information
- You can ask us to share or stop sharing information with your family, close friends, or others involved in your care or payment for your care. We may not be required to comply with these requests in all circumstances, for example we may disclose your information to your family if we believe disclosure is necessary to lessen a serious and imminent threat to health or safety.
File a complaint if you believe your rights are violated
- If you believe we have violated your rights, please let us know by contacting us at support@usenourish.com.
- You can also file a complaint with the U.S. Department of Health and Human Services Office for Civil Rights by sending a letter to 200 Independence Avenue, S.W., Washington, D.C. 20201, calling 1-877-696-6775, or visiting https://www.hhs.gov/hipaa/filing-a-complaint/index.html.
- We will not retaliate against you for filing a complaint.
Other Rights You May Have – Information Collected From Apps
Regarding health information we collect through mobile applications or “apps,” you also may have the right to request that we delete such information; however, your rights to deletion may be limited by legal obligations we may have to retain health information for certain purposes. Additionally, to the extent consent was obtained for the collection, use or other processing of health information collected through apps, you have the right to revoke such consent. To exercise either or both of these rights, send a request, with your name, phone number and email address, to support@usenourish.com.
OUR RESPONSIBILITIES
- We are required to maintain the privacy and security of health information, to notify you if your health information is disclosed or accessed in a way that would constitute a “breach” under applicable law, and to provide notice of our legal obligations and practices with respect to health information.
- We are required to use your health information in a manner that is consistent with this Notice and our obligations under applicable law.
- We must give you a copy of this Notice if you ask for it.

HEALTH APP DATA SHARING – APPLE HEALTH AND HEALTH CONNECT
The Apple HealthKit framework (available to users as Apple Health) on iOS and the Health Connect API (on Android) allow third-party health, fitness, and wellness applications to securely share, store, and synchronize health information on your device. If you choose to connect health information using these tools, we may request permission to access the following types of health information, for the following purposes:
- Weight – To track trends and support goals like weight loss, maintenance, or gain, depending on your health plan.
- Steps and Distance – To provide context on your daily activity, which can influence appetite, metabolism, and nutritional needs.
- Exercise – To understand the type, duration, and intensity of your training sessions and help support personalized guidance based on your workout habits and recovery needs.
- Resting Heart Rate – To give your dietitian a fuller picture of your baseline health and stress levels.
- Sleep – To help you and your dietitian understand how your sleep affects your hunger, energy levels, and eating patterns.
- Active Energy – To help you and your dietitian understand how much energy you burn throughout the day.
- Body Fat Percentage — To provide additional context alongside weight, so your dietitian can better interpret changes over time.
You are always in control of information shared with us through HealthKit/Apple Health and Health Connect. Each tool gives you the ability to consent to sharing the data with us, including different categories of data, and to change your preferences at any time, including revoking your consent to sharing one or more categories of data with us.
We will use health information you allow us to access through HealthKit/Apple Health and Health Connect to provide you with our services. Such information will constitute PHI subject to this Notice of Privacy Practices.
Notwithstanding any provisions of this Notice of Privacy Practices, we will not use information we collect through HealthKit/Apple Health or Health Connect for marketing, advertising or similar services and will not sell such information. We may disclose information obtained through HealthKit/Apple Health or Health Connect with third parties that provide a health or fitness service to you or that engage in medical research, but will do so only after obtaining your consent, including in accordance with any applicable laws.
CHANGES TO THE TERMS OF THIS NOTICE
We can change the terms of this Notice, and the changes will apply to all information we have about you. Revised Notices will be available on our website or through our mobile application.
